In a statement Tuesday, Lower Merion School District spokesman Doug Young said the district will appeal the court’s decision. Smyth issued an order preventing the board of school directors of enacting a tax of over 2.4 percent more than was in effect for the prior year. At the same time, county Court of Commons Pleas Judge Joseph A. LOWER MERION > Calling it “unlawful,” a Montgomery County judge Monday ordered the Lower Merion School District to rescind its 4.4 percent tax increase for the 2016-17 school year budget.
